                                     Health/Purchase Contract
                              *NOTE: Contract is Null & Void if puppy ownership changes!

We at Hay-Day Cockers love our dogs and puppies and for this reason we carefully research pedigrees
and only breed Healthy Cockers.  We only want to produce puppies who will live a long and healthy life
and provide years of happiness to their owner. All our puppies are certified Vet checked before new
home placement, they are de-wormed starting at 2 weeks of age and are continued to be de-wormed
on a 2 week interval. Pups are de-clawed and tails are docked.Our pups are vaccinated at 6 weeks of
age, and vaccinations are continued at 3 week intervals until new home placement. At this time buyer
will follow up on vaccination and de-worming schedule per seller's instructions. Please note that a
puppy's immune system is not totally matured and his/her immunity is only provided from the antibodies
from Mother's milk through nursing and continued through vaccinations.
A puppy is not fully immune to virus's until he/she has had 3 vaccinations administered. Puppies are
much like human infants and should be treated as such. It would be safe to keep your puppy away
from other puppies or dogs until it has had it's 3rd set of vaccinations, unless of course, you own the
(other) puppy or dog and you are sure that it would not be a carrier of a contagious virus. Even though
we put a lot of work and effort into providing healthy puppies, there may be a time when a defect in a
small pup will not be noticeable at time of new home placement. For this reason we offer a 72 hour
replacement guarantee for parvo, and /or  distemper only. We require that your puppy be Vet checked
by a certified Veterinarian of your choice within 72 hours from the time the puppy is received from seller.
Date and Time of delivery of pup to buyer will be noted on this contract.
We will not be responsible for any test or Vet charges that are incurred by buyer. We ask that if for some
reason the puppy is found to have  parvo or distemper that your Veterinarian would place this finding in
writing on His/ Her stationary notifying us as to the problems of the puppy. We ask that the new owner
contact us immediately by telephone to notify us of this finding and to send proof from the buyer's Vet. At
this time, seller (Hay-Day Cockers, Kenny McMillan) would replace puppy with one of
equal sex and value. If we do not have any available replacement puppies equal to the sell price of your
puppy at this time, we would notify client as soon as one becomes available. This health warranty does
not include or cover, cherry eye,  hernia, cataracts,  skin disorders, allergies, or behavioral problems.
Once a puppy leaves our premises it is the new owners responsibility to continue medical treatment
and check-ups, vaccinations, de-wormings and socialization of such puppy . Seller has no way of
controlling the situation of a puppy once it leaves our premises. This is why we like to get to know our
families and their intentions before we ever consider placing one of our babies. We would never
knowingly sell a sick or unhealthy puppy. It is a known fact that Cockers can have health problems,
however, at Hay-Day Cockers we try to do everything possible to prevent such. We do health testing
(Eye Cerf's and OFA hip testing)
to insure us that we are only mating two healthy Cockers. Our Cockers are very loving and friendly
and we would never own or mate an aggressive Cocker. Some puppies are born to be alpha
puppies while others are more submissive. This is when our role comes in as a breeder to try and
place a puppy with a family that will fit our puppies needs as well as the needs of the family. We like
to place our babies to fit in with a family like a hand in glove.
We will not be responsible for any charges of any type incurred by the puppy or buyer of such pup.
If the puppy has deceased without any testing or diagnosis by a certified Veterinarian, we the seller
will require that the puppy have a necropsy by a certified Veterinarian at the buyer's expense, in order
to prove cause of death before a replacement puppy will be offered by seller. Any and all charges
incurred by buyer for puppy, after initial sell of puppy from Seller will be the buyer's responsibility and
at the buyer's expense.
Puppies sold on a pet/companion AKC limited registration are Not sold for breeding purposes and
are Not to be registered with any other Club affiliation. They are PET COMPANIONS and are sold
ONLY to be loved and admired and not bred. We reserve the right to repossess any puppy or dog
when the owner does not abide by these STRICT rules. Repossession will be immediate and
mandatory! We will give full instructions on new puppy care, health care, including worming and
vaccination schedule and tips for housetraining. This will be included with the puppy care package.
NOTE: If ever a problem or conflict should occur concerning this legal and binding contract that cannot
be worked out between buyer and seller, then a legal decision would  be decided in a court of law
pertaining to the sell of one of our pups/ or dogs,.The complaint  will be submitted  and a decision
finalized in the legal court system of Forest, Mississippi, Scott County,  in which Hay-Day Cockers,
or Seller, known as Kenny McMillan resides. Please make a copy of this legal and
binding contract. Please fill in appropriate blanks, such as name, address, and telephone numbers,
Sign, date, and submit back to Hay-Day Cockers before puppy placement. All Balances on puppies less
deposit   (if deposit has been made) are due and payable at time of new home placement if picking
puppy up from our premises or 10 days prior to scheduled shipping date of pup, if being shipped via
airlines. Cash, postal money orders, or Wal-mart money orders or Pay-Pal ONLY will be accepted.
Buyer agrees that if for some reason they are unable to keep puppy at anytime within the pup or dog's
lifetime, buyer will offer seller first right of refusal before placing puppy with another owner.
Buyer and Seller agrees to all conditions of this contract, by signing contract, buyer and seller
also acknowledges that he/she is entering into a legal and binding contract.  This Completes page 1

NOTICE:  At no time will Seller, Kenny McMillan and/or Hay-Day Cockers, reimburse
Cash or any other form of US funds for the sale or replacement of any puppy or for any medical expense,
Veterinary expense, shipping or airline fee expense, boarding expense, food expense or any other
charges that may be incurred once buyer purchases puppy from Seller and/or anytime after the sell or
date of transaction of this contract.
